GENERAL TERMS AND CONDITIONS OF BUSINESS AND SALE

1. General Provisions

These General Terms and Conditions of Business and Sale govern the relationship between:

(hereinafter referred to as “Knjižara sv. Dominik”, the “Seller” or the “Merchant”)

and customers purchasing products through the online store ksvd.hr (hereinafter referred to as the “Customer”).

By using the online store and placing an order, the Customer confirms that they have been informed of and accept these General Terms and Conditions, the Privacy Policy and other information made available prior to completing the purchase.

These General Terms and Conditions form an integral part of the distance contract concluded between the Seller and the Customer.

The relationship between the Seller and consumers is governed by the applicable laws and regulations of the Republic of Croatia, in particular those governing contractual obligations, consumer protection and electronic commerce.

2. Customer

A Customer is any natural or legal person who orders a product through the ksvd.hr online store.

A consumer is a natural person who enters into a legal transaction or acts on the market for purposes outside their trade, business, craft or professional activity.

Minors and persons without full legal capacity may purchase products only in accordance with applicable law and with the required consent of their legal representative.

The Customer is responsible for the accuracy and completeness of the information provided when placing an order.

3. Products and Product Information

Products available for purchase are displayed in the ksvd.hr online store.

For each product, we endeavour to provide its essential characteristics, price, available variations and other information relevant to the Customer’s purchasing decision.

Product photographs are for illustrative purposes only.

Due to different screen settings, lighting conditions during photography, material characteristics, handmade production or differences between individual production batches, the colours, shades, textures and certain details of the actual product may differ slightly from those shown in the photographs.

For handmade products or products made from natural materials, minor variations in colour, structure, shape and finish may occur. Such minor variations resulting from the nature of the material or production method do not, in themselves, constitute a product defect.

Knjižara sv. Dominik endeavours to ensure that all descriptions, photographs, prices and other information are accurate and up to date.

In the event of an obvious technical, typographical or other error, the Seller will inform the Customer before delivery and offer the Customer the option to proceed with the purchase based on the corrected information or cancel the order.

4. Prices

All retail prices displayed in the online store are stated in euros (EUR) and include VAT where VAT is applicable.

The price applicable to the Customer is the price displayed at the time the order is placed, except in the case of an obvious pricing error.

Delivery costs, where applicable, are displayed separately before the order is completed.

Before confirming the order, the Customer will be shown the total amount payable, including the price of the products and any applicable delivery or other charges imposed by the Seller.

Online retail regulations require consumers to be informed, before entering into a contract, of the retail price as well as any transport, delivery or postal charges.

5. Ordering Procedure

Purchases are made by selecting the desired product and adding it to the shopping cart.

Before completing the purchase, the Customer can review the contents of the shopping cart, quantities, prices and other information and, where necessary, modify quantities or remove products.

The Customer then enters the information required for invoicing and delivery and selects one of the available delivery and payment methods.

Before finally submitting the order, the Customer has the opportunity to review the information entered.

By submitting the order, the Customer confirms that the order entails an obligation to pay.

After the order has been received, a confirmation of receipt will be sent to the Customer’s specified e-mail address.

The Customer is responsible for providing a valid e-mail address and other accurate contact details.

6. Conclusion of the Contract

The sales contract is concluded electronically.

The General Terms and Conditions made available to the Customer at the time the contract is concluded form an integral part of the contractual relationship.

We recommend that the Customer retain the order confirmation and these General Terms and Conditions for their own records.

7. Payment Methods

The Customer may use the payment methods offered in the online store at the time the order is placed.

Depending on the options currently available, payment methods may include:

  • bank transfer / online banking

  • card or other electronic payment

  • cash on delivery

  • other payment methods offered during the checkout process.

All payments are made in euros (EUR).

For card or other electronic payments, the transaction may be processed by an authorised payment service provider. Knjižara sv. Dominik does not store full payment card details where the transaction is processed through an external authorised payment service provider.

8. Cash on Delivery

If cash on delivery is available for a particular order, the Customer pays for the shipment upon delivery using the payment methods supported by the selected carrier.

Important notice: Certain delivery or postal service providers may charge the recipient an additional fee related to cash-on-delivery payment or the transfer of the amount collected.

Where such a fee is charged directly to the recipient by the delivery company or payment/postal service provider, it does not constitute revenue of Knjižara sv. Dominik.

9. Payment by Bank Transfer

If the Customer chooses payment by bank transfer, the payment details will be provided during the ordering process or in the order confirmation.

The order may be dispatched after payment has been received, unless otherwise agreed with the Customer.

The Seller may specify a reasonable period within which payment is expected. If payment is not received within that period, the order may be cancelled.

Any fees charged to the Customer by their bank or another payment service provider are borne by the Customer.

10. Product Availability

We endeavour to keep product availability information in the online store regularly updated.

In exceptional circumstances, a product displayed as available may no longer be in stock, for example because of simultaneous sales in a physical store and through the online store or due to a technical stock-recording error.

If an ordered product is unavailable, we will contact the Customer and, depending on the circumstances, offer a replacement product, the option to wait until the product becomes available, or cancellation of the order and a refund of any amount already paid.

11. Delivery

Delivery is carried out by delivery or postal service providers with whom Knjižara sv. Dominik cooperates.

Available delivery options and delivery charges are displayed to the Customer during the ordering process.

The Customer is responsible for entering a complete and accurate delivery address and contact details.

Delivery times stated on the website are estimated delivery times unless expressly stated otherwise.

Delivery times may be affected by circumstances beyond the Seller’s direct control, including the operation of the delivery service, public holidays, weather conditions and other exceptional circumstances.

12. Receipt and Inspection of the Shipment

We recommend that the Customer inspect the external condition of the parcel upon receipt.

If the parcel shows significant visible damage that may indicate damage to its contents, we recommend that the Customer immediately notify both the delivery service and Knjižara sv. Dominik.

If, after opening the parcel, the Customer finds that a product is damaged, incorrectly delivered or that part of the order is missing, they should contact us as soon as possible so that we can review the case and resolve the complaint.

13. Product Defects and Non-Conformity

The Seller is liable for material defects and/or non-conformity of goods in accordance with the applicable laws and regulations of the Republic of Croatia.

If a product has a defect for which the Seller is liable, the Customer has the rights provided by applicable law, depending on the circumstances of the individual case.

These rights may include repair, replacement, an appropriate price reduction or termination of the contract and a refund where the legal requirements for such remedies are met.

These rights do not affect any additional rights that the Customer may have under a commercial warranty, where such a warranty has been provided for a particular product.

14. Written Complaints and Claims

We recommend including the order or invoice number, a description of the issue and any other information that may help us establish the circumstances more easily.

If the complaint concerns damage or a defect that can be shown in a photograph, we recommend attaching photographs of the product and packaging.

We will respond to a consumer’s written complaint in writing no later than 15 days after receipt, as required by the Croatian Consumer Protection Act.

15. Right of Withdrawal

A consumer who has concluded a distance contract through the online store has the right, in cases provided for by law, to withdraw from the contract within 14 days without giving any reason.

For contracts for the sale of goods, the 14-day period generally begins on the day on which the goods are delivered into the possession of the consumer or a third party designated by the consumer who is not the carrier.

Where several products ordered in a single order are delivered separately, the withdrawal period begins on the day on which the consumer receives the final product or final shipment.

To exercise the right of withdrawal, the consumer must inform us of their decision by means of an unequivocal statement before the withdrawal period expires.

The consumer may use the prescribed withdrawal form, but use of that form is not mandatory if the consumer informs the Seller of the withdrawal in another clear and timely manner.

16. Return of Goods Following Withdrawal

If the consumer withdraws from the contract, they must return the goods without undue delay and within the applicable statutory deadlines.

The direct cost of returning the goods is borne by the consumer unless Knjižara sv. Dominik has expressly agreed to bear those costs or applicable law provides otherwise.

The consumer is liable for any diminished value of the product resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.

We recommend returning the product appropriately packaged to prevent damage during transport.

17. Refunds

In the event of a valid withdrawal from the contract, we will refund the amount paid by the consumer in accordance with applicable legal provisions.

The refund will be made without undue delay and no later than within the period prescribed by law.

The Seller may withhold the refund until the goods have been returned or until the consumer provides evidence that the goods have been sent back, whichever occurs first.

18. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply in cases where it is excluded by applicable law.

Of particular relevance to our product range is the exception concerning goods made to the consumer’s specifications or clearly personalised to meet the consumer’s individual requirements.

This may apply, for example, to products specially made or personalised at the Customer’s request.

Where a statutory exception to the right of withdrawal applies to a particular product, the Customer will be informed before purchase where applicable.

19. Incorrectly Ordered Product

If the Customer accidentally orders the wrong product, size, version or quantity, they should contact us as soon as possible.

If the order has not yet been dispatched, we will endeavour to make the requested change.

If the product has already been dispatched, the rules governing withdrawal and returns will apply, provided that the legal requirements for exercising those rights are met.

20. Personal Data Protection

We process Customers’ personal data in accordance with applicable data protection legislation.

Detailed information regarding the categories of personal data we process, the purposes and legal bases for processing, recipients of personal data, retention periods and data subject rights is available in our Privacy Policy on ksvd.hr.

21. Force Majeure

Knjižara sv. Dominik shall not be liable for any delay or inability to fulfil its obligations where this results from circumstances that could not reasonably have been foreseen, avoided or remedied and which are beyond the Seller’s reasonable control, to the extent permitted by law.

22. Dispute Resolution

In the event of a dispute, the Seller and the Customer will endeavour to resolve the matter amicably in the first instance.

Consumers may exercise their rights through consumer protection mechanisms and the competent authorities in accordance with the applicable laws and regulations of the Republic of Croatia.

For individual consumer claims, the first step is to submit a written complaint to the Merchant.

Contractual relationships are governed by the laws of the Republic of Croatia, without prejudice to any consumer rights arising from mandatory legal provisions.

23. Amendments to the General Terms and Conditions

Knjižara sv. Dominik may amend these General Terms and Conditions in order to comply with changes in legislation, business practices, payment methods, delivery arrangements or online store functionality.

Each individual order is governed by the General Terms and Conditions that were available to the Customer at the time the contract was concluded.

The date of the most recent amendment will be published on this page.
